Terms & conditions
Last updated
These terms apply to your use of this website and to services provided by aethal (“we”). A signed proposal or statement of work for your project takes priority over these terms where they differ. This is a starting draft and should be reviewed by a legal professional before launch.
Using this website
Content on this site is for general information. Fees are set out in your written proposal, which is the one that applies.
Engagements
- Every engagement starts with a written proposal describing scope, deliverables, timeline and fees.
- Monthly services run month-to-month and either side can end them with 30 days' written notice.
- One-time builds are invoiced 50% before work starts and 50% on delivery, unless the proposal says otherwise.
- Invoices are due within 7 days. GST is added for Indian clients where applicable.
Ad spend and third-party costs
Advertising spend, software subscriptions (such as CRM or WhatsApp Business Platform fees) and other third-party costs are paid by you directly to those providers unless agreed otherwise in writing.
Your accounts and ownership
Ad accounts, social accounts, websites, CRM data and other accounts are set up in your name. Once paid for, the work we create for you is yours. We may show non-confidential work in our portfolio unless you ask us not to.
Results
Marketing results depend on many factors outside our control, including your market, offer and budget. We commit to doing the work described in the proposal carefully and reporting honestly; we do not guarantee specific results.
Liability
To the extent the law allows, our total liability for any engagement is limited to the fees you paid us for that engagement in the three months before the claim.
Cancellations and refunds
See our cancellation & refund policy.
Governing law
These terms are governed by the laws of India. Courts at our registered place of business have jurisdiction.
